1. Scope
(1) These Terms and Conditions ("Terms") set out the rules governing every transaction made through the online shop at novira.com between the shop operator (hereinafter "NOVIRA", "we", "us") and the purchaser (hereinafter "you", "Buyer"). Our range of goods covers the home and garden categories.
(2) A consumer under these Terms is any natural person who concludes a legal transaction for purposes that are predominantly unrelated to any trade, craft, business or self-employed profession. A commercial buyer is any natural or legal person, or a legally capable partnership, acting within the scope of their trade, craft or professional activity when the contract is entered into.
(3) Any terms submitted by the Buyer that are at odds with, diverge from or add to these Terms shall be incorporated into the agreement only where we have explicitly acknowledged them in writing.
2. Contracting Party and Contact

3. Conclusion of Contract
(1) The display of home and garden goods in our online shop does not represent a legally binding offer; it functions as a non-binding invitation to browse our catalogue and place an order.
(2) By clicking "Buy" / "Place order" / "Pay now", you submit a binding offer to purchase the items in your shopping basket.
(3) Acknowledgement of receipt and acceptance of your order are issued simultaneously — you will be notified immediately after placing your order by means of an automatically generated email. The agreement of sale becomes legally binding upon dispatch of that confirmation.
(4) We retain the contract text and forward it to you together with these Terms by email. The version of these Terms currently in force can be viewed at any time at novira.com/terms-of-service.
(5) All agreements are concluded and conducted in the English language.
4. Prices and Shipping Costs
(1) All prices shown on the website are inclusive of the applicable statutory Value Added Tax. Any delivery charges are presented separately at the point of checkout.
(2) For shipments to countries outside the European Union and the United Kingdom, additional customs duties, local taxes and other levies imposed by the destination country may apply, all of which fall to the Buyer.

5. Payment Terms
(1) The following payment methods are accepted: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay and bank transfer. We reserve the right to make individual payment methods unavailable in specific instances.
(2) The full purchase amount falls due upon conclusion of the agreement.
(3) Where payment is made by credit card or via PayPal, the charge is applied to your account immediately upon completion of your order.
6. Delivery
(1) Goods are sent to the delivery address provided by the Buyer. Applicable timeframes are indicated clearly on each product page and again at the checkout stage.
(2) Should delivery prove impossible after three attempts, we are entitled to withdraw from the agreement. Any sums already collected will be returned to you without undue delay.
(3) Where delays are caused by force majeure, the relevant delivery window will be extended accordingly. We will notify you promptly in such cases.
7. Retention of Title
Goods dispatched remain the property of NOVIRA until the full purchase price has been received in cleared funds.
8. Right of Cancellation for Consumers
Consumers benefit from a statutory right of cancellation. Full details and the model cancellation form are set out on our Cancellation Policy & Returns page.
9. Warranty and Liability for Defects
(1) Statutory rules on liability for defects apply without restriction. For consumers, the limitation period for claims arising from defects in the goods is two years from the date of delivery.
(2) For used goods, the limitation period is one year from the delivery date.
(3) Should a delivered item be defective, please reach out to us at contact@novira.com.
10. Liability
(1) We accept unlimited liability in cases of intent and gross negligence, as well as within the scope of applicable consumer protection law.
(2) In cases of ordinary negligence, our liability is confined to breaches of a cardinal contractual obligation — one whose discharge is essential to the proper performance of the agreement and upon which the Buyer may legitimately rely. In such instances, liability is capped at loss that was foreseeable and characteristic for this type of contract.
(3) The above limitations do not affect our liability for death, personal injury or harm to health.
11. Dispute Resolution
(1) The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
12. Applicable Law and Jurisdiction
(1) This contractual relationship is governed solely by the laws of England and Wales, with the UN Convention on Contracts for the International Sale of Goods expressly excluded. In relation to consumers, this governing law is applied only insofar as the mandatory protections of the law of their habitual country of residence are not thereby removed.
(2) Where the Buyer is a merchant, a body corporate under public law or a public-law special fund, the courts at our registered place of business shall have sole jurisdiction over disputes arising from this agreement.
13. Final Provisions
Should any provision of these Terms prove or become invalid or unenforceable, in whole or in part, the validity of the remaining provisions shall be unaffected. The applicable statutory provision shall substitute for any clause that cannot be upheld.
